Welcome to Nexlink Car. These Terms and Conditions (“Terms”) govern your access to and use of the Nexlink Car website, services, vehicle listings, and purchasing process.

By accessing our website, submitting an enquiry, paying a deposit, placing an order, or purchasing a vehicle from Nexlink Car, you confirm that you have read, understood, and agreed to these Terms.

1. General Information

Nexlink Car supplies new and used vehicles, including electric, hybrid, luxury, and fuel-powered vehicles.

These Terms apply to website visitors, customers, prospective buyers, and anyone using our services.

We reserve the right to update, modify, or replace these Terms at any time. Changes will become effective when published on our website. Your continued use of the website after changes are published constitutes acceptance of the revised Terms.

2. Vehicle Listings and Availability

All vehicles displayed on our website are subject to availability and may be sold, reserved, removed, or replaced without prior notice.

We make reasonable efforts to ensure that vehicle descriptions, photographs, specifications, mileage, model years, colours, features, battery ranges, and other information are accurate. However, minor differences or errors may occasionally occur.

Photographs may be provided for reference purposes. Lighting, screen settings, vehicle condition, optional equipment, and regional specifications may cause the actual vehicle to appear different from the images displayed.

Customers must confirm all important specifications, features, conditions, and requirements with Nexlink Car before making a payment.

Submitting an enquiry, adding a vehicle to a wishlist, or requesting a quotation does not reserve the vehicle.

3. New and Used Vehicle Condition

New vehicles may have limited delivery, testing, transportation, or inspection mileage.

Used vehicles are sold according to their existing age, mileage, condition, service history, and available documentation. Normal signs of previous use may be present.

Where possible, Nexlink Car will disclose known material defects or damage. Customers may request additional photographs, videos, inspection reports, or vehicle information before purchase.

The customer is responsible for reviewing the available information and deciding whether the vehicle meets their requirements before confirming the order.

4. Vehicle Inspections

Customers may arrange an independent vehicle inspection before completing the purchase, subject to availability and prior approval from Nexlink Car.

Inspection fees and related costs are generally the customer’s responsibility unless otherwise agreed in writing.

If a customer chooses not to inspect the vehicle before purchasing it, the customer accepts the vehicle based on the information, photographs, videos, and documents provided.

An inspection does not guarantee that a vehicle will remain free from future mechanical, electrical, battery-related, or cosmetic issues.

5. Pricing and Quotations

Unless otherwise stated, prices displayed on our website are shown in United States Dollars (USD).

Website prices may represent the vehicle price only and may not include shipping, insurance, customs duties, taxes, inspection charges, port fees, registration fees, banking fees, documentation fees, or other destination-related expenses.

A formal quotation will explain the charges included in the proposed transaction.

Vehicle prices may change due to availability, exchange-rate movements, supplier pricing, shipping costs, taxes, or market conditions.

A quotation remains valid only for the period stated in the quotation. Nexlink Car reserves the right to correct pricing or listing errors before accepting or completing an order.

6. Orders and Purchase Confirmation

An order is not considered confirmed until:

Nexlink Car confirms the vehicle’s availability;
The customer accepts the final quotation or sales agreement;
Any required deposit or payment has been received and verified; and
Any required identity, delivery, or compliance information has been provided.

Nexlink Car may reject or cancel an order if the vehicle is unavailable, the payment cannot be verified, the transaction appears fraudulent, legal or export restrictions apply, or incorrect pricing or vehicle information was displayed.

If Nexlink Car cancels an order after receiving payment and the cancellation is not caused by the customer, any eligible amount will be refunded according to the agreed payment and refund terms.

7. Deposits

A deposit may be required to reserve a vehicle or begin purchasing, documentation, inspection, preparation, or shipping arrangements.

Unless otherwise agreed in writing, deposits may become non-refundable after Nexlink Car has reserved the vehicle, purchased it from a supplier, prepared documentation, arranged transportation, or incurred costs connected with the order.

The deposit amount, payment deadline, and refund conditions will be stated in the quotation, invoice, or sales agreement.

Failure to pay the remaining balance by the agreed deadline may result in cancellation of the reservation. Nexlink Car may deduct reasonable costs already incurred before issuing any eligible refund.

8. Payment

Payments must be made using a payment method approved by Nexlink Car and specified in the quotation or invoice.

The customer is responsible for ensuring that all payment information is correct and that payments are made from a lawful and authorised source.

Bank transfer charges, intermediary bank fees, currency-conversion costs, and payment-processing fees are the customer’s responsibility unless otherwise agreed.

The vehicle will not normally be released, shipped, or transferred until cleared payment has been received in full.

Nexlink Car may request additional information to verify a payment or comply with fraud-prevention, anti-money-laundering, banking, export, or legal requirements.

9. Shipping and Delivery

Nexlink Car may assist with domestic or international vehicle transportation through independent shipping companies, freight forwarders, ports, and logistics providers.

Shipping prices and delivery times are estimates unless expressly guaranteed in writing.

Delivery may be affected by port congestion, customs inspections, carrier schedules, weather, regulatory requirements, strikes, public holidays, documentation delays, or other circumstances outside our reasonable control.

Nexlink Car is not responsible for delays caused by third-party carriers, customs authorities, ports, government agencies, or incorrect information supplied by the customer.

The customer must provide accurate recipient, destination, telephone, identification, and delivery information. Additional expenses resulting from incorrect or incomplete information will be the customer’s responsibility.

10. Risk and Ownership

Ownership of the vehicle will transfer according to the terms stated in the invoice, sales agreement, shipping document, or other written agreement.

Risk of loss or damage may transfer to the customer when the vehicle is handed over to the customer, shipping carrier, freight forwarder, or other nominated logistics provider, depending on the agreed shipping terms.

Customers are encouraged to obtain suitable marine, cargo, transportation, or vehicle insurance.

Nexlink Car is not responsible for loss or damage occurring after risk has transferred to the customer, except where responsibility cannot legally be excluded.

11. Customs, Taxes and Import Requirements

The customer is responsible for confirming that the selected vehicle can legally be imported, registered, insured, and operated in the destination country or region.

The customer is also responsible for applicable:

Customs duties and import taxes;
Value-added tax or sales tax;
Port, storage, clearance, and handling fees;
Vehicle inspections and testing;
Registration and licensing;
Local emissions and safety compliance;
Homologation or vehicle modification requirements; and
Destination-country documentation.

Nexlink Car may provide general assistance or documentation, but this does not constitute legal, customs, tax, or regulatory advice.

Nexlink Car is not responsible if a vehicle cannot be imported, registered, insured, or legally operated because of destination-country requirements that were not confirmed by the customer before purchase.

12. Documentation

Depending on the vehicle and transaction, Nexlink Car may provide available documents such as a commercial invoice, sales contract, export declaration, certificate of origin, vehicle registration document, inspection record, shipping document, or other applicable paperwork.

Document availability and format may vary according to the vehicle, supplier, exporting country, destination, and applicable regulations.

The customer must review their documentation requirements before ordering and notify Nexlink Car of any specific requirements in advance.

Nexlink Car is not responsible for costs or delays caused by documentation requirements that were not disclosed before the order was confirmed.

13. Cancellations, Returns and Refunds

Due to the nature, value, registration status, transportation requirements, and individual specifications of vehicles, confirmed vehicle orders cannot normally be returned or cancelled simply because the customer changes their mind.

Cancellation and refund eligibility will depend on the stage of the transaction, the terms of the quotation or sales agreement, and the costs already incurred.

Vehicles that have been specially sourced, purchased, reserved, modified, registered, prepared, exported, or shipped for a customer may not be eligible for cancellation or return.

Where a refund is approved, Nexlink Car may deduct non-recoverable expenses, including banking fees, inspection costs, transportation fees, documentation costs, supplier charges, storage fees, and currency-conversion losses.

Approved refunds will be returned through an appropriate payment method. Processing times may vary depending on banks, payment providers, and international transfer requirements.

Nothing in this section limits any mandatory consumer rights that apply under applicable law.

14. Warranty and After-Sales Support

Warranty coverage, if available, will vary according to the vehicle’s manufacturer, age, mileage, condition, supplier, and destination country.

Any warranty offered for a specific vehicle must be confirmed in writing before purchase.

Unless expressly stated in writing, used vehicles are sold in their existing condition and may not include a manufacturer’s warranty.

Warranty coverage may exclude normal wear and tear, consumable parts, tyres, batteries, cosmetic damage, accident damage, misuse, unauthorised modifications, improper maintenance, unsuitable charging equipment, environmental damage, and damage caused during transportation after risk has transferred.

The customer must follow the manufacturer’s operating, servicing, charging, maintenance, and safety instructions.

15. Electric and Hybrid Vehicles

Advertised electric driving ranges, charging times, battery capacities, and fuel-consumption figures are manufacturer estimates or test-cycle results.

Actual performance may vary depending on temperature, driving style, speed, traffic, vehicle load, battery condition, road conditions, tyre pressure, use of air conditioning, charging equipment, and other factors.

Customers are responsible for confirming charging-port compatibility, electrical standards, software availability, mobile connectivity, navigation support, language settings, and access to suitable charging infrastructure in their location.

Some connected services, applications, driver-assistance systems, maps, or software features may be restricted or unavailable outside the vehicle’s original market.

16. Customer Responsibilities

By placing an order, the customer confirms that:

They are legally able to enter into the transaction;
The information they provide is accurate and complete;
They have reviewed the vehicle details and purchase terms;
They have confirmed applicable import and registration requirements;
They will make payment from a lawful and authorised source; and
They will not use the vehicle or our services for unlawful purposes.

The customer must promptly notify Nexlink Car of any error in their personal, payment, delivery, or documentation information.

17. Website Use

You may use our website only for lawful purposes.

You must not attempt to damage the website, introduce malicious software, gain unauthorised access, collect information through automated means without permission, interfere with website operation, or use our content for fraudulent or misleading activities.

We may suspend or restrict access to the website if we reasonably believe these Terms have been violated.

18. Intellectual Property

All website content, including text, logos, graphics, vehicle presentations, page designs, photographs owned by Nexlink Car, and other materials, is protected by applicable intellectual-property laws.

You may not copy, reproduce, republish, distribute, sell, modify, or commercially use our website content without prior written permission.

Vehicle manufacturers’ names, logos, and trademarks belong to their respective owners. Their appearance on our website does not imply sponsorship or endorsement unless expressly stated.

19. Third-Party Services and Links

Our website may contain links to payment providers, shipping companies, social-media services, manufacturers, or other third-party websites.

Nexlink Car does not control and is not responsible for third-party websites, services, privacy practices, availability, content, or security.

Your use of a third-party service may be governed by that provider’s own terms and policies.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Nexlink Car will not be liable for indirect, incidental, special, punitive, or consequential losses arising from the use of our website, delayed delivery, vehicle purchase, import restrictions, loss of use, loss of income, or third-party services.

Where liability cannot legally be excluded, Nexlink Car’s total liability relating to a particular transaction will not exceed the amount paid directly to Nexlink Car for that transaction.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

21. Events Beyond Our Control

Nexlink Car will not be responsible for a failure or delay caused by events outside our reasonable control.

These events may include natural disasters, severe weather, war, civil disturbance, government action, changes in law, epidemics, port closures, customs delays, transport disruption, strikes, supplier failure, banking disruption, internet outages, or shipping-carrier delays.

We will make reasonable efforts to inform affected customers and continue the transaction when reasonably possible.

22. Privacy

We respect your privacy and handle personal information according to our Privacy Policy.

By using our website or providing information to us, you acknowledge that your information may be processed where reasonably necessary to respond to enquiries, verify payments, complete transactions, arrange shipping, prepare documents, prevent fraud, and meet legal obligations.

23. Governing Law and Disputes

These Terms and any transaction with Nexlink Car will be governed by the laws applicable to the jurisdiction in which Nexlink Car is legally registered, unless another governing law is expressly stated in the sales agreement.

The parties should first attempt to resolve any dispute through good-faith communication.

Where a dispute cannot be resolved informally, it will be handled by the courts or dispute-resolution authority identified in the applicable sales agreement or required under applicable law.

24. Severability

If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to remain effective.

25. Entire Agreement

These Terms, together with the applicable quotation, invoice, sales agreement, Privacy Policy, Shipping Policy, and Refund and Returns Policy, constitute the agreement between the customer and Nexlink Car.

Where a written sales agreement conflicts with these general Terms, the specific terms of the signed sales agreement will take priority for that transaction.
